ENTERTAINMENT WORKERS BARGAINING AGREEMENT.

ALL TERMS AND CONDITIONS HEREIN APPLY TO ANY USE OF
THEEVENTLINE.COM EQUIPMENT AND SERVICES.

TheEventLine.com, Inc is the "PROVIDER",
the equipment renter and/or services user is the "USER".

The Entertainment Workers serving USER's event are covered by an agreement which lists terms and conditions under which their services can be used. The USER is responsible for meeting these requirements and all costs of doing so while the workers are serving USER.

 

1. DANGEROUS OR HOSTILE WORK ENVIRONMENT. A DANGEROUS or HOSTILE WORK ENVIRONMENT (“HWE”) SHALL NOT be created by USER or any participant in USER's event through the use of: (1) threat, (2) assault and/or battery, (3) sexual misconduct, (4) profane, cursing or demeaning language, (5) unsafe conditions or (6) refusal to abide by the contract. Further, no worker shall be asked to perform during inclement weather conditions as defined in Section 1 of the Policy-BW (Bad Weather Policy) or refused shelter in such conditions.

2. FREEDOM OF MOVEMENT. The right of a worker to move about or leave the event site SHALL NOT be restricted or hindered except that it may be limited to the actual event space and unhindered egress to and from that site.

3. BREAKS. All workers shall receive a 15 minute break every 2 hours and an additional 15 minute break (totaling a continuous 30 minutes) every 4 hours. USER shall be responsible for assuring adequate staffing during break periods. Should there not be enough staffing available, use of effected equipment will be discontinued during these periods with no adjustment, compensation or offset and no consideration against the in-service warranty. Break periods shall count towards hours of service provided to USER.

4. MAXIMUM WORKDAY. No worker may labor over 16 hours in any one day. This includes travel, setup, event and take-down times.

5. MEALS AND LODGING.

5.1 MEALS. If the onsite hours required for any worker exceeds 5 hours in any one day, the USER shall provide a suitable meal for that worker. If the onsite hours required for any worker exceeds 9 hours in any one day, the USER shall provide two suitable meals for that worker. Any such costs paid by PROVIDER shall be reimbursed by USER. It is agreed such costs will be limited to $6 for breakfast, $8 for lunch and $10 for dinner.

5.2 LODGING. If the onsite hours required for any worker exceeds 12 hours in any one day, the USER shall provide suitable lodging for that worker. Any such costs paid by PROVIDER shall be reimbursed by USER.

6. FREE PARKING AND ADMISSION. The USER shall provide free admission to and free parking at the event site for all workers or cover all such costs. Any such costs paid by PROVIDER shall be reimbursed by USER.

7. WORKER RESTRICTION. USER shall have minimal rights, if any, to restrict the natural conditions and life choices of workers except as provided by law. Workers may only be limited based upon proven abilities.

7.1 LANGUAGE. While it is PROVIDER's policy that all workers speak American English during onsite periods, USER may not restrict worker's use of any language.

7.2 RELIGION. While PROVIDER is a faith-based Christian business, USER may not restrict workers on any religious basis.

7.3 GENDER. USER may not limit workers to any gender or set any unlawful conditions based on gender.

7.4 NATIONAL ORIGIN. USER may not limit workers based upon national origin.

7.5 SMOKING. No worker may be restricted from smoking unless prohibited by law or a suitable designated smoking area within 100 yards of the event site is provided. A suitable location will have signage, ash trays and seats. If smoking is prohibited by law or a suitable designated smoking area is not available, USER shall give PROVIDER a minimum one weeks notice of such and pay a $0.50 per work hour premium for non-smoking workers.

7.6 ILLEGAL ACTIVITIES, ALCOHOLIC and ILLEGAL DRUG CONSUMPTION. USER shall have every right to restrict illegal activities including onsite alcoholic beverage and illegal drug consumption. When alcoholic beverages are legally consumed onsite, workers may be restricted to consumption only during off-duty periods. For the purpose of this determination, breaks are considered on-duty.
